In order to back up a partition that's still mounted, you have to use the -A option in fsarchiver (forces it to continue and ignore the mount warning).

Odd... Guess that's what I get for not testing it! (happens the same to me when I apply the patch). I'm wondering if it has something to do with copying/pasting from the forum post.
